Introductory Provisions

1.1

These Terms and Conditions (hereinafter referred to as the “Terms”) of the online store operated via the Domain regulate the mutual rights and obligations of the contracting parties arising in connection with or based on a purchase agreement (hereinafter referred to as the “Purchase Agreement”) concluded between the seller, the Operator (hereinafter referred to as the “Seller”), and another natural or legal person (hereinafter referred to as the “Buyer”) through the Seller’s online store. The online store is operated by the Seller on the website specified under the Domain via a web interface (hereinafter referred to as the “Store Web Interface”). These Terms also regulate the rights and obligations of the contracting parties when using the Seller’s website located at the Domain (hereinafter referred to as the “Website”) and other related legal relationships.

1.2

According to applicable legislation, a distinction is made between a consumer Buyer (i.e., any individual acting outside the scope of their business activity or independent profession when concluding a contract with a business entity) and a business Buyer (i.e., a person acting within the scope of their business activity, trade, or profession for profit).

1.3

Any provisions differing from these Terms may be agreed upon in the Purchase Agreement. Such differing provisions in the Purchase Agreement shall take precedence over these Terms.

1.4

These Terms form an integral part of the Purchase Agreement. The Purchase Agreement and these Terms are prepared in the English language. The Purchase Agreement may be concluded in English.

1.5

The Seller may amend or supplement these Terms. This shall not affect rights and obligations arising during the validity of previous versions of the Terms.

1.6

All contractual relationships are governed by the laws of the Czech Republic. If the contractual party is a consumer, relationships not regulated by these Terms are governed by Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection. If the contractual party is a business entity, relationships not regulated by these Terms are governed by Act No. 89/2012 Coll., the Civil Code.

User Account

1.7

Based on the Buyer’s registration on the Website, the Buyer may access their user account. Through the user account, the Buyer may order goods (hereinafter referred to as the “User Account”). If enabled by the Store Web Interface, the Buyer may also place orders without registration directly through the Store Web Interface.

1.8

When registering on the Website and placing orders, the Buyer is obliged to provide accurate and truthful information. The Buyer must update all information in the User Account whenever changes occur. The information provided by the Buyer in the User Account and during ordering is considered accurate by the Seller.

1.9

Access to the User Account is secured by a username and password. The Buyer is obliged to maintain confidentiality regarding information necessary to access the User Account and acknowledges that the Seller is not responsible for any breach of this obligation by the Buyer.

1.10

The Buyer is not entitled to allow third parties to use the User Account.

1.11

The Seller may cancel the User Account, especially if the Buyer has not used the account for more than two years or if the Buyer breaches obligations arising from the Purchase Agreement (including these Terms).

1.12

The Buyer acknowledges that the User Account may not be available continuously, especially with regard to necessary maintenance of the Seller’s hardware and software equipment or the hardware and software equipment of third parties.

Conclusion of the Purchase Agreement

1.13

The Store Web Interface contains a list of goods offered by the Seller for sale, including prices of individual products. Product prices include VAT and all related fees. Offers and prices remain valid as long as displayed on the Store Web Interface. The Seller is not obliged to conclude a Purchase Agreement regarding displayed goods.

1.14

The Store Web Interface also contains information about packaging and delivery costs. These delivery cost details apply only to deliveries within the Czech Republic and Slovakia.

1.15

To order goods, the Buyer completes the order form in the Store Web Interface. The order form mainly contains information about:

  • ordered goods added to the shopping cart,
  • payment method,
  • delivery method,
  • delivery costs.

1.16

Before submitting the order, the Buyer is allowed to review and modify entered data, including correcting errors. The Buyer submits the order by clicking the “Confirm Order” button. Information provided in the order is considered correct by the Seller. Upon receiving the order, the Seller will confirm receipt via an automatically generated email sent to the Buyer’s email address.
